SAN DIEGO — In a case that could put a new spotlight on the drug’s potential role in treating erectile dysfunction, a Florida man has been found to have erectile dysfunction, according to theSan Diego Daily Newsreports.
A former colleague, Robert C. Taulton, who is known for allegedly prescribing the drug for Viagra and other prescription drugs, was arrested by U. S. Immigration and Customs Enforcement’s Homeland Security Investigations and U. Postal Service officers on suspicion of having shipped counterfeit Viagra pills from India to San Diego in the early 2000s. Taulton was charged with smuggling and trafficking controlled substances, including Viagra, from the United States, and also bringing a variety of illegal goods and contraband into the United States.
“Counterfeit Viagra products were shipped into San Diego,” Taulton said in a statement, noting that the FDA has “discussed the issue with the agency and issued a public advisory.”
While Customs agents seized several counterfeit Viagra pills, Taulton was arrested on suspicion of distributing and possessing the pills. The investigation revealed that Taulton had shipped Viagra and other prescription drugs to San Diego in the summer of 2000, before traveling to the US. Taulton and other U. Customs officers seized and arrested Taulton, along with a number of other counterfeit pills, in connection with a trafficking of drugs in the US and other countries.
The case against Taulton involved the sale of drugs by an illegal distributor to various retail pharmacies, the statement said.
“We are currently pursuing an investigation to determine whether the product was shipped by the distributor or not,” the statement said. “A search warrant was executed at the premises of one of the defendants in this case and the seized drugs were subsequently found to be in violation of Title 18 U. C. § 924(e)(1)(B)(iv) and (e)(1)(C)(iii).”
The drug and counterfeit pills may have originated from India, the statement said. Customs officers were notified by Customs officials in mid-2001 about the trafficking of counterfeit Viagra, which they believed was imported from India.
“Counterfeit Viagra drugs were shipped into the United States from India and imported into the United States from a variety of foreign countries,” it said.
In January 2005, Taulton was detained at his home in San Diego, where he was living in fear for his safety. After being arrested, he was charged with importing and selling controlled substances, and was also found guilty of the smuggling and trafficking. Taulton’s attorney was then ordered to surrender his client’s DNA and evidence. Taulton was also convicted of conspiracy, importation and possession of controlled substances.
“The defendant has been convicted of a number of criminal charges related to his conduct in this case, and we are committed to bringing forward any information which may assist the defendant and the public,” the statement said. “We will continue to follow through on our responsibility to the public and the courts.”
The following day, Taulton was arrested for allegedly smuggling drugs and counterfeit drugs into the United States. Customs agents were sent to a residence in San Diego to arrest him and search his person. They then seized the drugs from him and arrested him at his home in San Diego.In an interview with theDaily News, Taulton said he was arrested on the same date that his client was arrested, and that he “was in a very bad emotional state.”
He also denied that he was involved in the trafficking, and the statement said Taulton “did not possess or sell any drugs.”
According to the statement, Taulton’s lawyer, John G. O’Brien, told Taulton’s story before being taken into custody on May 17, 2003. O’Brien did not specify the date of his arrest, but Taulton’s attorney said that the case has yet to be determined. The statement also said Taulton “has been placed on probation,” meaning he will have to serve out the remainder of the terms of his probation.
“We will continue to follow through on our responsibility to the public and the courts,” O’Brien said.
The case against Taulton was not resolved until the statement was made public.
